Felony DUI/DWI and Repeat Offenses

Minneapolis/St. Paul Felony and Repeat DUI/DWI Lawyer

If you have been charged with your second, third or fourth DUI, DWI or OUI, you are probably aware that penalties increase with each alleged violation. Penalties for repeat offender arrests include:

  • For a second offense occurring within 10 years of a previous violation, there is a 30-day mandatory minimum jail term, a maximum fine of $3,000 and mandatory 180 day suspension of your license.
  • For a third offense occurring within 10 years of a previous violation, there is a 90-day mandatory minimum jail term, a maximum fine of $3,000 and mandatory one-year suspension of your license.
  • A fourth conviction within 10 years of three other convictions is a felony and can bring fines of $14,000 and seven years in prison. Violations may also be classified as felonies if someone is injured due to a DUI, DWI or OUI. The severity of the injuries can influence sentencing.

At the law firm of Max A. Keller, Attorney at Law, we offer effective defense of your felony and repeat DUI, DWI and OUI charges and are skilled in arguing for reduced sentencing. Individual courts, court staff and your individual circumstances, like having a child at home, mobility issues and willingness to enter a treatment program when applicable, can all play a part in the level of sentencing you receive. We have a long record of successfully obtaining sentencing for our clients which is well below minimum mandatory requirements.

We can also have your license temporarily reinstated and can work to obtain a work permit or limited license. The loss of your driving privileges can rapidly lead to employment issues, including losing your job or having to accept a lower paying position. Our 10 years of experience and success in helping over a thousand Minnesotans fight their DUI, DWI and OUI charges ensures your optimum chance for minimizing the legal effects of your charges.
